PARTNER VISA SUBCLASSES 820/801 AND 309/100 and 309
Options for Partner Visas
Your location at the time of application, the length of your relationship, and the type of relationship you are in—de facto, engaged, or married—will all determine which partner visa option is best for you.
1. Subclass 300 Fiancé (Prospective Marriage) Visa
You could submit an application based on your desire to get married.
With this visa, you can enter Australia and start working right away. You must get married during the nine to fifteen months that this temporary visa is issued in order to apply for the onshore 820/801 visa.
2. Subclass 309/100 or 820/801 Partner Visa
If you can provide proof of one of the following partnerships, you might also be eligible for a partner visa:
- Getting married
- De facto partnership for a minimum of 12 months
- Your de facto relationship’s official registration
3. New Zealand Partners of Australian citizens
You might be able to apply for a temporary 5-year partner visa if you are the partner of a New Zealand citizen who resides in Australia.
SKILLED VISA SUBCLASSES 189, 190 AND 491
The General Skilled Migration (GSM) program serves as a primary route for skilled professionals looking to permanently relocate to Australia. Its goal is to attract individuals who can aid the Australian economy by addressing skill shortages across various sectors. Candidates are evaluated based on criteria such as age, educational background, professional experience, and proficiency in English.
A points-based system is used to assess eligibility, with a greater number of points enhancing the chances of receiving an invitation to apply.
The GSM Program’s Competitiveness
The GSM program is quite competitive. The quantity of invitations granted is influenced by Australia’s current economic requirements and labor market needs. Certain professions may be in higher demand, which affects the number of invitations offered to applicants in those areas.
Obtaining a visa through the GSM program is not assured. Although you may satisfy the minimum points requirement and other criteria for eligibility, the selection process is competitive, and only the top candidates receive invitations to apply. Furthermore, fulfilling the eligibility standards does not guarantee that a visa will be granted, as every application is subject to a comprehensive evaluation.
General Skilled Migration Visa Subclasses There are various subclasses under the GSM. Some of these subclasses offer a pathway to permanent residency, while others are classified as temporary or provisional.
- Skilled Independent – Subclass 189 (Permanent Residency)
- Skilled Nominated – Subclass 190 (Permanent Residency)

EMPLOYER SPONSORED VISA SUBCLASSES 186, 482
Subclass 186 Employer Nomination Scheme visa
This visa allows skilled workers nominated by their employer to reside and work in Australia on a permanent basis.
Basic Eligibility
- You need to possess the required skills for the position.
- You must receive a nomination from an Australian employer.
- You must satisfy our health and character standards.
The Employer Nomination Scheme visa (Subclass 186 ENS) is a permanent residency visa that necessitates the support of a nominating employer.
In brief: The 186 visa includes a Transition stream, Direct Entry Stream, and 186 Agreement stream.
- You must possess an occupation listed on the 186 Visa Occupations List. English language requirements stipulate an IELTS (or equivalent test) score of at least 6 in all components.
- Applicants for the Direct and Transition Entry streams must be no older than 45 at the time of their application.
- Several amendments have been made to strengthen the integrity of the ENS and RSMS visas, including the requirement for the nominated position to be legitimate and the removal of the English language and skills exemption for applicants whose nominated earnings exceed $180,000.
